1. Acceptance of Terms

By downloading, installing, or using the RoxHype mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

RoxHype is an AI-powered training application designed for HYROX athletes. The App provides:

  • Personalized workout plans generated by artificial intelligence
  • Exercise demonstrations and instructional videos
  • Progress tracking and analytics
  • Training resources and information

3. Subscription and Payment Terms

3.1 Subscription Options

  • Monthly Subscription: $19.99 per month
  • Prices are in USD and may vary by region

3.2 Billing

  • Payment will be charged to your Apple App Store or Google Play Store account
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

3.3 Cancellation

  • You can cancel your subscription at any time through your device's app store settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

3.4 Free Trial

  • New users may be offered a free trial period
  • If you don't cancel before the trial ends, you will be automatically charged

4. User Account

4.1 Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account
  • You must be at least 13 years old to use the App

4.2 Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized use
  • We reserve the right to suspend or terminate accounts for violations

5. User Content and Conduct

5.1 Your Content

  • You retain ownership of any content you submit
  • By submitting content, you grant us a license to use it for providing services
  • You are responsible for your content's accuracy and legality

5.2 Prohibited Conduct

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to hack, reverse engineer, or disrupt the App
  • Share your account with others
  • Use the App to harm yourself or others
  • Violate any applicable laws or regulations

6. Health and Safety Disclaimer

6.1 Medical Disclaimer

THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE

  • Consult with a healthcare provider before beginning any exercise program
  • The App is for informational and training purposes only
  • We are not responsible for any injuries or health issues

6.2 Assumption of Risk

  • You acknowledge that exercise involves risk of injury
  • You voluntarily assume all risks associated with using the App
  • Listen to your body and stop if you experience pain or discomfort

6.3 No Medical Advice

  • The App does not provide medical, health, or fitness advice
  • Information provided is general and may not be suitable for your specific situation
  • Always seek professional guidance for health concerns

7. Intellectual Property

7.1 Our Property

  • All App content, features, and functionality are owned by RoxHype
  • Protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, or distribute without permission

7.2 Limited License

  • We grant you a limited, non-exclusive, non-transferable license to use the App
  • For personal, non-commercial use only
  • This license can be revoked at any time

8. Third-Party Services

  • The App integrates with third-party services (Supabase, OpenAI, RevenueCat)
  • These services have their own terms and privacy policies
  • We are not responsible for third-party services or content

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED

9.2 No Warranties

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • Results from using the App will meet your expectations

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the last 12 months
  • Some jurisdictions don't allow these limitations, so they may not apply to you

10. Indemnification

You agree to indemnify and hold harmless RoxHype, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

11. Changes to Terms

  • We may modify these Terms at any time
  • Changes are effective upon posting
  • Continued use after changes constitutes acceptance
  • We will notify you of material changes

12. Termination

12.1 By You

  • You may terminate by deleting the App and cancelling your subscription

12.2 By Us

  • We may terminate or suspend your account for violations
  • We may discontinue the App at any time

12.3 Effect of Termination

  • Upon termination, your right to use the App ceases
  • Provisions that should survive termination will remain in effect

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the United States and the State of California

13.2 Dispute Resolution

  • We will try to resolve disputes informally first
  • If unsuccessful, disputes will be resolved through binding arbitration
  • You waive the right to jury trial or class action

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and RoxHype

14.2 Severability

If any provision is found invalid, the remaining provisions continue in effect

14.3 Waiver

Failure to enforce any right is not a waiver of that right

14.4 Assignment

You may not assign these Terms; we may assign them without restriction

16. Special Provisions for App Store

16.1 Apple App Store

  • These Terms are between you and RoxHype, not Apple
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for any product claims
  • Apple is a third-party beneficiary with the right to enforce these Terms

16.2 Google Play Store

  • These Terms are between you and RoxHype, not Google
  • You must comply with Google Play Terms of Service
  • Google has no obligation regarding the App

17. Export Control

You may not use or export the App in violation of U.S. export laws and regulations.

18. Privacy

Your use of the App is also governed by our Privacy Policy, available at our Privacy Policy.

BY USING ROXHYPE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
